Key Differences from Federal Rules of Evidence

  • I.R.E. 702 follows a Daubert-like reliability analysis for expert testimony, requiring that scientific, technical, or specialized knowledge will assist the trier of fact
  • I.R.E. 404(b) requires the state to provide reasonable pretrial notice of intent to offer other-acts evidence and articulate a permissible purpose
  • I.R.E. 803(24) (residual exception) requires corroborating circumstances clearly indicating trustworthiness, applied more restrictively than FRE 807
