An acquittal is a legal judgment that a criminal defendant is not guilty of the charged offense. An acquittal may result from a jury verdict of not guilty or from a directed verdict of acquittal by the judge (judgment of acquittal under Rule 29). Once acquitted, the defendant cannot be retried for the same offense due to the Double Jeopardy Clause of the Fifth Amendment.

An acquittal may occur at several stages: during trial if the judge grants a Rule 29 motion finding insufficient evidence, or after the jury returns a not guilty verdict. When the judge directs an acquittal, they determine that no reasonable jury could find guilt beyond a reasonable doubt based on the evidence presented. After acquittal, the defendant is immediately released from custody if detained. The prosecution cannot appeal an acquittal, making it the most final of all criminal dispositions.
